1. Acceptance of Terms
By accessing and using the services provided by Impromptu Success ("Company," "we," "our," or "us"), located at 6188 Ambleside Dr Unit A, Columbus, Ohio, you ("Customer," "you," or "your") agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Services Provided
Impromptu Success offers a variety of technology repair, business consulting, document preparation, and related services including but not limited to:
- Computer, phone, tablet, and game console repair
- Data recovery and virus removal
- Network setup and hardware upgrades
- Business consulting and penetration testing
- Website development and digital marketing
- Notary services and document preparation
- 3D printing and custom application development
- U-Haul services, copy/print services, and other convenience services
3. Service Estimates and Pricing
All pricing estimates provided are subject to change based on the actual work required. We will notify you of any significant price changes before proceeding with the work. Diagnostic fees may apply and will be disclosed upfront. If you decline repair after diagnosis, the diagnostic fee remains due.
Payment Terms
- Payment is due upon completion of services unless other arrangements are made in writing
- We accept cash, credit cards, and other payment methods as posted in our facility
- A deposit may be required for certain services or high-value repairs
- Late payments may incur additional fees
4. Warranty and Guarantees
Repair Services Warranty
We provide a 90-day warranty on parts and labor for most repair services. This warranty covers:
- Defects in parts installed by us
- Workmanship related to the specific repair performed
- Failure of repaired components under normal use
Warranty Exclusions
The warranty does NOT cover:
- Damage caused by misuse, abuse, or accidents after service
- Liquid damage, physical damage, or modifications made after service
- Issues unrelated to the original repair
- Used or refurbished parts supplied by the customer
- Software issues, viruses, or malware infections
- Data loss of any kind
- Normal wear and tear
5. Data Backup and Loss
IMPORTANT: You are solely responsible for backing up your data before any service. While we take reasonable precautions to protect your data, we are NOT responsible for any data loss that may occur during service, repair, or diagnostic procedures.
We strongly recommend that you:
- Back up all important data before bringing devices to us
- Remove sensitive or personal information when possible
- Keep copies of important files in multiple locations
Data recovery services are provided on a best-effort basis with no guarantee of success.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- Our total liability for any claim shall not exceed the amount paid for the specific service
- We are not liable for indirect, incidental, special, consequential, or punitive damages
- We are not liable for loss of profits, revenue, data, or business opportunities
- We are not responsible for the content, accuracy, or legality of customer-provided materials
- We are not liable for delays caused by factors beyond our reasonable control
7. Customer Responsibilities
As a customer, you agree to:
- Provide accurate information about device issues and history
- Disclose any previous repairs or modifications
- Remove passwords, locks, and security features before service when possible
- Retrieve completed items within 30 days of notification
- Pay all applicable fees in a timely manner
- Provide valid contact information for service updates
8. Abandoned Property
If you fail to retrieve your device or property within 30 days of completion notification, or within 60 days if no repair was performed, your property may be considered abandoned. We reserve the right to dispose of abandoned property and charge storage fees. We will make reasonable attempts to contact you before disposal.
9. Third-Party Services and Products
We may recommend or use third-party services, software, or products. We are not responsible for the performance, quality, or issues related to third-party offerings. Any warranties or guarantees on third-party products are provided by the manufacturer.
10. Business Consulting and Professional Services
For business consulting, penetration testing, and professional services:
- Services are provided based on our professional judgment and industry best practices
- We do not guarantee specific business results or outcomes
- You are responsible for implementing any recommendations
- Confidential information will be handled in accordance with our Privacy Policy
- Detailed service agreements may be required for complex projects
11. Notary Services
Notary services are performed in accordance with Ohio state law. The notary:
- Acts as an impartial witness and does not provide legal advice
- Verifies identity and willingness to sign documents
- Maintains records as required by law
- May refuse service if legal requirements are not met
12. Intellectual Property
For website development, graphic design, and custom application services:
- Upon full payment, you receive ownership of the final deliverables
- We retain rights to use work samples for portfolio and marketing purposes
- You must provide legal rights to any materials you supply
- Third-party licenses for software, fonts, or stock images are your responsibility
13. Cancellation and Refund Policy
- Service appointments may be cancelled or rescheduled with 24 hours notice
- Deposits are non-refundable if we have ordered parts or begun work
- Refunds for services are provided at our discretion on a case-by-case basis
- Diagnostic fees are non-refundable once service has begun
14. Privacy and Confidentiality
We respect your privacy and handle your personal information in accordance with our Privacy Policy. We maintain confidentiality of your business and personal information, except as required by law.
15. Dispute Resolution
In the event of a dispute:
- We encourage you to contact us directly to resolve issues
- If resolution cannot be reached, disputes shall be governed by Ohio law
- Venue for any legal action shall be in Franklin County, Ohio
- You agree to first attempt mediation before pursuing litigation
16. Buy, Sell, and Trade Electronics
For our electronics buy, sell, and trade services:
- Purchases: All purchased devices are tested and sold "as-is" with a 30-day functional warranty unless otherwise stated
- Sales: We provide fair market value assessments based on device condition, age, and market demand
- Trade-ins: Trade-in values are determined at time of assessment and valid for 7 days
- Device Condition: All devices must be accurately represented; misrepresented condition may result in revised offers
- Ownership Verification: You must provide proof of ownership and ensure devices are not reported lost or stolen
- Data Responsibility: You are responsible for backing up and wiping personal data before sale or trade-in
- Payment: Payments for purchased devices are made via cash, check, or store credit at time of transaction
- Returns: Purchased devices may be returned within 30 days with original receipt and in same condition
- iCloud/Account Locks: Devices with activation locks, iCloud locks, or account restrictions will not be accepted
- Final Sale: Trade-in and sell transactions are final once payment is accepted
17. Changes to Terms
We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes constitutes acceptance of the modified terms. We encourage you to review these terms periodically.
18. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
